Public Fireworks Displays
Do I need to make copies of the downloaded public display permit application and submit three copies as before?
The old Public Fireworks Display Permit application was printed on NCR paper allowing for the necessary copies to be submitted. With the change in the form and its availability to be downloaded, it is only necessary to complete and submit the original application. The necessary copies will be made after the application is approved and mailed to the listed distributor(s) and sponsoring organization.
Can I fax in the display permit application? Can I fax the application to the fire chief for his/her signature and have it faxed back to us?
No. The application submitted to this office must be the original. We will not accept faxed signatures. Although it is not possible to “sign” the online application, whoever is responsible for submitting the permit application shall print off a copy and obtain the signature of the fire chief or his/her designated representative and the public display operator supervising the display. This copy shall be kept on file in the event that the State Fire Marshal requests to see it to ensure proper permission was received.
On the old permit application we drew a diagram of the area where the display would be held. Now the form has categories where we are to enter the distances. Must a distance be entered for all fields?
This change was made to allow us to develop the online application. Basically, the information you enter in the distances field would be the same as if you were drawing a diagram. If one of the fields, such as penal complex or health care facility, is miles away from the display area then the category may be left blank. Distances still need to be entered in feet.
Why do I need a permit to shoot fireworks?
State Statute 28-1239.01 requires anyone conducting a public exhibition or display of fireworks to procure a display permit from the State Fire Marshal. This statute also prohibits a licensed distributor to sell or deliver display fireworks to any person who does not possess an approved display permit.
Is an inspection of the site required?
State Fire Marshal personnel will periodically conduct unannounced inspections of display sites to insure regulations are being followed and the information provided on the permit application is accurate.
How much does it cost to get a permit?
A Public Firework Display Permit is $10 per date (does not include rain date). Only one date per application is permitted. The fee is non-refundable and is payable by check or money order if the application is being mailed in or by credit card (Master Card or Visa only) if the application is submitted online. The fee will be charged against your card as soon as you submit the application.
Do I need a permit if I am shooting Class C fireworks that I purchased at a retail stand?
No. A permit is only required if Class B fireworks are being shot.
The online application won’t accept my credit card.
Only Visa or Master Card may be used. Some credit card vendors set up cards so they cannot be used with online applications. If you are unable to get your application through with one credit card, please try a different credit card and see if that will go through. If you are still having difficulties, please write down any errors you are receiving or make a screen shot of the error and email to this office.
